Terms and Conditions
1. Introduction
These terms and conditions ("Terms") form a legally binding agreement between you and Toy and Game School ("Toy and Game School", "we", "us" or "our"), and they govern your use of our websites, online course platform, digital content, and any related services (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Services.
2. About Toy and Game School
Toy and Game School is an online education website providing digital video lessons, resources, and related materials to help users learn about toy and game design. It is NOT an accredited school, college, or university, and we do not issue formal academic qualifications. Any certificates or acknowledgements we may provide are for illustrative or motivational purposes only and are not recognised as formal qualifications by any government or accrediting body.
The information and materials provided through the Services are for educational and informational purposes only. They do not constitute professional advice (including but not limited to legal, financial, engineering, health or safety advice). If you choose to apply any techniques, tools, or processes described in the course, you do so at your own risk and are responsible for using appropriate safety equipment, following applicable laws, and taking proper safety precautions.
3. Eligibility, accounts and membership
You must be at least 16 years of age to use the Services. By using the Services, you represent and warrant that you are at least 16 years old. If you use the Services on behalf of a company or other legal entity, you represent and warrant that you have authority to bind that entity to these Terms, and references to "you" in these Terms will also refer to that entity.
If you create an account, you agree to provide accurate, current and complete information and to keep that information up to date. You are responsible for maintaining the confidentiality of your login details and for all activities that occur under your account. You must notify us immediately if you become aware of any unauthorised use of your account or any other breach of security.
4. Course access, account sharing & no earnings / job guarantee
Upon successful payment, we grant you a personal, non-transferable licence to access Toy & Game School for your own individual learning.
Unless we state otherwise at the time of purchase, this access is provided for as long as we make the course available online ("course life").
We may update, modify or replace the course and its contents from time to time. If we decide to discontinue the course entirely, we will use reasonable efforts to give you at least 30 days’ notice (for example, by email or by a notice in your account).
Nothing in this section affects any non-excludable rights you have under applicable consumer law.
Accounts and sharing
Your account and login details are personal to you. You must keep them confidential and must not share them with any other person or allow others to access the course using your account.
You must not resell, rent out, or otherwise commercially exploit your access to Toy & Game School or any of the course materials. You may not copy, distribute, upload, record or make available any part of the course materials to the public or to any third party, except where we clearly allow downloading or printing for your personal use. So-called "group buys" (where multiple people contribute to purchase one licence or account) are not permitted. We may suspend or terminate your access if we reasonably believe you have breached this clause.
No earnings or job guarantee
Toy & Game School is an educational resource and does not guarantee that you will achieve any particular results, employment, earnings, business outcomes, or commercial success. Your outcomes depend on many factors beyond our control, including your skills, effort, previous experience and market conditions. Any examples of results, past successes or student stories we share are illustrative only and are not promises of what you will achieve.
5. Fees, payments & 14-day refund ("14-Day 100% Satisfaction Promise")
All fees are payable in advance. Access to Toy & Game School is provided as a digital online course.
We offer a 14-day refund if you are not satisfied (our "14-Day 100% Satisfaction Promise"). If Toy & Game School is not a fit for you, you may email us at [email protected] within 14 days of your initial purchase and request a full refund. We may ask for feedback to help us improve, but you are not required to give any reason in order to receive a refund within this 14-day period.
After the 14-day period has expired, we do not offer refunds, except where required by applicable law.
If you are a consumer resident in the UK or EU, you may have a statutory "cooling-off" right for digital content purchased online. Toy & Game School is supplied as online digital content and you will normally be able to start accessing the course immediately after purchase. By completing your purchase and starting to access the course during the cooling-off period, you acknowledge that you are requesting immediate access to the digital content and that, where permitted by law, once the digital content has been fully supplied or significantly consumed you may lose any statutory right to change your mind in relation to that purchase.
This is in addition to our 14-Day 100% Satisfaction Promise described above and does not affect any non-excludable rights you have under applicable consumer law.
6. User content and licences
When you upload, post or otherwise submit any content to Toy & Game School ("User Content"), you retain ownership of your rights in that User Content.
You grant us a non-exclusive, worldwide, royalty-free licence to host, store, use, reproduce and display your User Content only as necessary to operate, maintain and provide the Services to you and other users (for example, to show your posts inside any community area, to back up data, or to process assignments and messages). This licence ends when you or we delete that User Content from the Services, except to the extent we are required to retain copies for legal or legitimate business purposes (such as record-keeping and backups).
If you choose to make User Content public (for example, by posting in a community area that is visible to other users, or by tagging us or using hashtags such as #toyandgameschool on social media), you grant us an additional non-exclusive, worldwide, royalty-free licence to use, reproduce, adapt, publish and display that public User Content for our own marketing and promotional purposes, including on our website, emails and social media channels.
You can withdraw this marketing licence at any time for future use by contacting us at [email protected]. When you do so, we will stop using that content in new marketing materials within a reasonable time. This will not require us to: (a) remove or recall content that has already been printed, published or distributed, or (b) remove copies of your content that are outside our reasonable control (for example, content shared by other users or stored in search engine caches, backups or archives).
We will not use your private coursework, assignments, or other non-public uploads (for example, files stored only in your account or private submissions to tutors) in our public marketing without your separate, explicit consent.
7. Acceptable use
You must use the Services in a lawful, responsible and respectful manner. You agree not to use the Services to upload, post, share or otherwise transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, obscene, infringing, or otherwise objectionable, or that violates any third party's rights.
You also agree not to interfere with or disrupt the operation of the Services, attempt to gain unauthorised access to any systems or networks, or use the Services to distribute malware, spam, or other harmful code. Additional rules and examples of prohibited conduct may be set out in our Acceptable Use Policy, which is incorporated into these Terms by reference.
8. Intellectual property
All content and materials made available through the Services, including but not limited to videos, text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, and software, are owned by or licensed to Toy and Game School and are protected by copyright, trade mark and other intellectual property laws.
We grant you a limited, non-exclusive, non-transferable licence to access and view the course materials for your own personal, non-commercial use in accordance with these Terms. You must not reproduce, distribute, modify, create derivative works of, publicly perform, publicly display, republish, download, store or transmit any of the course materials except as expressly permitted in these Terms or with our prior written consent.
9. Third-party services
The Services may integrate with or link to third-party platforms, tools, or services (such as our course hosting provider, payment processors, or social media platforms). These third-party services are provided by independent providers and are subject to their own terms and privacy policies. We do not control and are not responsible for the content, functionality, or practices of third-party services.
10. Disclaimers and educational nature of the Services
The Services and all information provided through them are for educational and informational purposes only. We do not provide professional advice of any kind. You should seek independent professional advice where appropriate.
We do not promise that the Services will be uninterrupted or error-free, or that any particular results will be achieved. Access to the Services may be temporarily suspended or restricted for maintenance, updates, or for reasons beyond our reasonable control.
11. Limitation of liability
Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law.
Subject to the above, and to the maximum extent permitted by law:
- the Services and course materials are provided "as is" and we do not guarantee that you will achieve any particular results, outcomes, employment, earnings, business benefits or commercial success;
- we are not liable for any loss of profits, revenue, business, contracts, goodwill, anticipated savings, data, or for any indirect or consequential loss or damage; and
- our total aggregate liability to you arising out of or in connection with the Services or these Terms (whether in contract, tort, negligence or otherwise) will be limited to the total fees you have paid to us for access to Toy & Game School during the 12-month period immediately preceding the event giving rise to the claim.
Nothing in this section affects any non-excludable rights you have under applicable consumer law.
12. Indemnity
To the extent permitted by law, you agree to indemnify and hold harmless Toy and Game School, its owners, officers, employees, contractors and agents from and against any claims, liabilities, damages, losses and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your breach of these Terms; (b) your use or misuse of the Services; or (c) your violation of any law or the rights of any third party.
13. Termination and suspension
We may suspend or terminate your access to the Services, or remove any User Content, at any time if we reasonably believe that you have breached these Terms, violated applicable law, or that your continued use of the Services poses a risk of harm or liability to us, other users, or third parties.
You may stop using the Services and close your account at any time. Termination does not entitle you to a refund except where expressly provided in these Terms or required by law.
14. Changes to the Services and these Terms
We may update, modify or discontinue parts of the Services from time to time to improve them or reflect changes in our business or the law. We will endeavour to avoid changes that materially reduce the value of the course for existing customers, but we cannot guarantee that the Services will remain unchanged.
We may also update these Terms from time to time. If we make material changes, we will take reasonable steps to notify you (for example, by email or by posting a notice within the Services). The updated Terms will apply from the date specified in the notice. If you continue to use the Services after the updated Terms take effect, you will be deemed to have accepted them.
15. Governing law and jurisdiction
These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) are governed by the laws of England and Wales.
If you are a business user, the courts of England and Wales will have exclusive jurisdiction over any dispute or claim arising out of or in connection with these Terms.
Nothing in these Terms affects any rights you may have under applicable consumer law in your country of residence.
